Qbraska operates a steadily expanding network of commercial partners and global suppliers. While our primary strategic allies are located within the United States, we continuously integrate inventory sourced from Latin America, Europe, Asia, Oceania, and the United Kingdom. This market diversity allows us to comprehensively meet each customer's preferences; however, in certain instances, the international origin of these items may result in extended transit times.
Our estimated delivery timeframes are structured as follows:

Fast Local Deliveries (24h to 3 days): This preferential timeframe applies solely and exclusively within the city of Lincoln, Nebraska, and is strictly limited to local stock products directly labeled under the Qbraska corporate brand.

Products within the United States (Domestic): For the rest of the U.S. territory, the standard estimated delivery time is a maximum of 7 business days.

External and International Suppliers: The delivery process may take between 10 and 21 days, depending strictly on the product's country of origin.

1. Scope of Application and Contractual Subject Matter
This document constitutes a legally binding contract between you (hereinafter, the "User", "Buyer", or "Customer") and Qbraska LLC (hereinafter, "Qbraska"), a limited liability company incorporated under the laws of the State of Nebraska, USA. This contract governs the access, download, installation, browsing, and use of the Qbraska mobile application, the official website, and all related digital services.
2. Express Consent and Contract Formation (Clickwrap)
Accessing, creating an account, or executing any monetary transaction within the platform constitutes the unequivocal manifestation of the User's consent to these Terms and Conditions.
This contract acquires full legal validity and enforceability at the exact moment the User actively checks the empty digital verification box (checkbox) stating: "I have read and accept the Terms and Conditions and the Refund Policy", provided in the account registration forms or the final checkout interface. The User declares that they have had a full and prior opportunity to review this document. If you do not agree with these provisions, you must refrain from using Qbraska's services immediately. No legal validity will be recognized for platform use or payments based on tacit browsing or implied acceptance.
3. Nature of the Platform (Limitation as an Intermediary)
Qbraska operates strictly as a Marketplace (technological intermediary) that provides digital infrastructure for independent businesses and registered third parties (hereinafter, "Sellers") to publish, offer, and sell their merchandise. Qbraska does not own, manufacture, distribute, import, or directly sell the physical items listed by third parties. Consequently, Qbraska is exempt from any liability related to the quality, safety, legality, defects, brand authenticity, factory warranties, or physical delivery of such products, which obligations fall exclusively on the Seller.
4. Primacy of Special Deadlines for Incident Reporting
The maximum and non-extendable deadlines for a Buyer to report a defective, damaged, incomplete item, or an item that does not match the published description are governed entirely by the specific times detailed by commercial category in Document 3: Refund and Return Policy.
The User expressly accepts that the general provisions of these General Terms shall not extend, modify, or revoke the specific deadlines established in said Refund Policy. Once the deadline corresponding to the product category has expired, the Buyer irrevocably waives any right to a claim or commercial dispute against Qbraska.
5. Exclusion of Warranties and Limitation of Liability
To the maximum extent permitted by the laws of the State of Nebraska and the federal laws of the United States, Qbraska's services are provided "as is" and "as available". Qbraska, its directors, employees, and agents shall not be liable under any circumstances for direct, indirect, incidental, punitive, special, or consequential damages. This includes, but is not limited to: loss of profits, service interruptions, cyberattacks, loss of data, illegal interception of communications by third parties, or fraudulent use of the application by Users or Sellers.
6. Anti-Fraud Mechanisms and Chargeback Resolution
Qbraska will actively cooperate with banking institutions and credit card issuers (Visa, Mastercard, American Express, among others), providing internal audit logs, IP addresses, logistics proofs of delivery, and audiovisual packaging evidence to combat financial fraud.
If the card issuer or an internal investigation determines that a chargeback constitutes an act of deliberate friendly fraud or bad faith claim, Qbraska reserves the right to permanently suspend the User's account, immediately terminate any ongoing contractual obligation, and permanently block their access to the platform, without prejudice to any civil or criminal actions that may correspond under the laws of the State of Nebraska.
7. Governing Law, Jurisdiction, and Arbitration Opt-Out Clause
This contract shall be governed by and construed exclusively under the laws of the State of Nebraska, without giving effect to its conflict of laws principles. Any dispute arising from this agreement shall be definitively resolved through binding individual arbitration administered by the American Arbitration Association (A) in accordance with its Commercial Arbitration Rules, in the city of Lincoln, Nebraska. Both parties expressly waive their right to resolve disputes before civil courts and to participate in class actions.
Right to Opt-Out: Users acting as end consumers have the right to reject this mandatory arbitration. To do so, they must send a written notice to the email address legal@qbraska.com within thirty (30) calendar days following the creation of their account, detailing their full name, linked email, and an explicit statement of opt-out. If this right is exercised in due time and form, the exclusive jurisdiction to resolve any dispute shall be the state or federal courts of Lancaster County, Nebraska.
